Information on personal data PROCESSING pursuant to article 13 of EU Regulation 2016/679 (hereinafter, GDPR)

In this privacy notice, the 2i Rete Gas Group refers to 2i Rete Gas S.p.A., concessionaire that operates in the public distribution of natural gas, and its associated companies and subsidiaries, representatives, employees as well as any partners. 

The 2i Rete Gas Group, as Data Controller, hereby informs you that pursuant to Article 13 of EU Regulation 2016/679 (hereinafter, “GDPR”) the Personal Data provided through this website may be subject to processing, in compliance with the aforementioned regulation and confidentiality obligations, according to the procedures and for the purposes described below. It also informs you that the company Cogitek S.r.l., with registered office in Rome, Via Fregene, 14, VAT and Tax Identification Number 06012550015 (referent Mr Pierantonio Piana, email: cogitek@legalmail.it) has been appointed as Data Protection Officer.

SUBJECT OF DATA PROCESSING

Pursuant to Article 4, Point 2 of the Regulation, processing refers to “any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.”

PERSONAL DATA RECIPIENTS

Please note that (without prejudice to the request for your consent in the cases required by law) the Personal Data you provide may be made accessible for the aforementioned purposes:

  • to the employees and collaborators of the Data Controller, as persons authorised to process data, or to Group companies present in the European Union, which may act as independent Data Controllers, or as Data Processors if appointed for the purpose;
  • to third-party companies or other entities that carry out outsourced activities on behalf of the Data Controller in the capacity of external processors;
  • to the subjects to whom disclosure is required by law, who will process your data as Data Controllers.

PURPOSE OF PROCESSING AND LEGAL BASIS

The Data Controller will process your Personal Data for the achievement of specific purposes and only in the presence of a specific legal basis provided for by the applicable law on privacy and personal data protection. Specifically, your data will be processed for purposes related to the reciprocal obligations deriving from the contractual relationship established and the Data Controller will only process your Personal Data in the presence of one or more of the following legal bases:

  • you have given free, specific, informed, unambiguous and express consent to the processing;
  • the processing is necessary for the performance of obligations envisaged by the contract with the data subject (natural/legal person);
  • for the realisation of all operational and management activities pertaining to the contract (e.g. invoicing, credit protection, administrative, management and organisational services functional to the performance of the contract);
  • in the presence of a legitimate interest of the Data Controller;
  • the Data Controller is required to process Personal Data by law;
  • in case of specific consent, for statistical surveys on the degree of customer satisfaction;
  • in case of specific consent, for communications about commercial initiatives promoted by Group Companies.

The processing of your Personal Data does not require consent, pursuant to Article 6, Letters b), c) and d) of the GDPR, when strictly necessary for the following purposes: 

  • the performance of obligations envisaged by the contract in place with the data subject (natural/legal person);
  • the fulfilment of legal obligations by the Data Controller;
  • the performance of a public interest task.

No profiling activities will be carried out on the data communicated.

PROCESSING METHODS

The processing of your Personal Data is carried out by means of the operations indicated in Article 4, Point 2, of the GDPR and more precisely: collection, recording, organisation, storage, consultation, adaptation or alteration, retrieval, use, erasure or destruction of data. The data will be processed using tools that guarantee security and confidentiality and may also be performed using automated tools to store, manage and transmit the data.

Please note that your Personal Data will be:

  • processed lawfully and correctly;
  • collected and recorded for specific, express and legitimate purposes and used in other processing operations compatibly with such purposes;
  • exact and, if necessary, updated;
  • relevant, complete and not excessive in relation to the purposes for which it is collected or subsequently processed;
  • stored in a form that allows identification of the data subject for a period of time no longer than that necessary for the purposes for which it is collected or subsequently processed.

DATA RETENTION

The Personal Data processed for the purposes mentioned above will be stored according to the principles of proportionality and necessity, and in any case until the purposes of the processing have been fulfilled.

Your Personal Data will normally be kept for the duration of the contractual relationship with the Data Controller, without prejudice to the need for the collection of residual credits and/or the management of data in the event of any disputes or complaints, such as those concerning invoices issued or the performance of the services requested.

In any case, your Personal Data will be automatically erased 10 years after the termination of the contractual relationship, without prejudice to the possible retention of the same where necessary for the purposes of managing on-going legal actions or the fulfilment of specific legal obligations.

DATA TRANSFER

Personal Data is stored in electronic archives located in Italy and in the EU; no personal data is transferred to third countries or international organisations.

NATURE OF DATA PROVISION AND CONSEQUENCES OF REFUSAL

It being understood that you have the right to object, in whole or in part:

  • to the processing of your personal data, for legitimate reasons, even if relevant for the purpose of the collection;
  • to the processing of your personal data for the purpose of sending advertising materials, direct sales or for the performance of market research or commercial communications;

please note that the provision of data for the purposes mentioned in Article 2 is compulsory and in the absence of the same, the requested activity may not be carried out. In this regard, it is specified that the acquisition of data that has or shall be requested is an essential prerequisite for the performance of the activities requested on the portal and that any refusal to provide the data requested at the time of collection may make it objectively impossible for the undersigned to establish or regularly conduct a contractual relationship with you.

RIGHTS OF THE DATA SUBJECT

In your capacity as data subject, you are guaranteed the rights referred to in Article 15 et seq. of the GDPR and in particular:

  • the right to obtain confirmation of the existence or non-existence of personal data and communication of the same in an intelligible form, and to be informed of the origin, purpose and methods of processing;
  • the right to obtain indication of the identification details of the data controller, the data processors and the subjects or categories of subjects to whom your Personal Data may be communicated;
  • the right to verify the accuracy of your Personal Data and to request additions, updates or corrections;
  • the right to request the erasure, transformation into anonymous form or blocking of personal data processed in violation of the law, as well as the limitation thereof pursuant to the law and in any case to oppose the processing of your personal data for legitimate reasons, except as provided for under Article 17, Paragraph 3, of the GDPR Regulation;
  • the right to data portability as well as the right to submit a complaint, report or appeal to the Italian Data Protection Authority, provided the conditions are met.

How to manage preferences and provide or withdraw consent

There are various ways to manage Tracker related preferences and to provide and withdraw consent, where relevant:
